Welcome to blondiespools.com. These Terms & Conditions ("Terms") govern your access to and use of the website located at blondiespools.com (the "Site") and your request for and use of services offered by Blondie's Pools LLC, doing business as Blondie's Pool Services ("Blondie's," "we," "us," or "our"). By accessing the Site, submitting a form, or communicating with us, you agree to these Terms. Please read them carefully and keep a copy for your records.

If you do not agree to these Terms, please do not use the Site.

1. Who We Are

Blondie's is a residential pool cleaning and maintenance company serving the Austin, Texas area. The Site provides information about our services and allows you to request service, contact us, and communicate with us.

2. Eligibility

You must be at least 18 years old and able to form a legally binding contract to request service or submit information through the Site. By using the Site, you represent that you meet these requirements. If you are under 18, you may use the Site only with the involvement of a parent or guardian.

3. Requesting Service

The Site allows you to request pool cleaning service by submitting a form or contacting us by phone, text, or email. Submitting a request does not create a service relationship or obligate either party. Pool service is provided under a separate service agreement between you and Blondie's, which governs the scope of service, pricing, scheduling, guarantees, and cancellation. In the event of a conflict between these Terms and your service agreement, the service agreement controls as to the services described in it.

Pricing and service details shown on the Site are for general information, may change, and are not an offer or guarantee of any particular price. Final pricing is confirmed with you directly before service begins.

4. SMS / Text Messaging Terms

These SMS Messaging Terms apply to the Blondie's text messaging program and are part of these Terms.

Program description. By opting in, you agree to receive recurring text messages from Blondie's related to your inquiry, scheduling, and pool service — including appointment confirmations, service-day reminders, follow-ups after a visit, account and billing notices, and replies to messages you send us.

How to opt in. You can opt in by checking the SMS consent box on our Site's forms, by texting us first, or by otherwise providing your mobile number and agreeing to receive texts. Consent to receive text messages is not a condition of purchasing any goods or services.

Message frequency. Message frequency varies based on your service and interactions with us.

Cost. Message and data rates may apply. These charges come from your mobile carrier and are your responsibility. Blondie's does not charge for text messages.

How to opt out. You can opt out at any time by replying STOP to any message. After you send STOP, we will send one confirmation message and then stop sending texts, except you may still receive individual replies to messages you send us.

Carriers. Mobile carriers are not liable for delayed or undelivered messages. Delivery is subject to effective transmission by your carrier and is not guaranteed.

Your information. Mobile information and SMS consent are never shared with or sold to third parties or affiliates for marketing or promotional purposes. We share this information only with our messaging service provider as needed to operate the text messaging program. See our Privacy Policy for details.

5. Electronic Communications

When you visit the Site or send us emails or texts, you are communicating with us electronically and consent to receive communications from us electronically. You agree that all agreements, notices, disclosures, and other communications we provide electronically satisfy any legal requirement that such communications be in writing.

6. Intellectual Property

All content on the Site — including text, graphics, logos, images, photographs, the Blondie's name and marks, and their arrangement — is owned by or licensed to Blondie's and is protected by copyright, trademark, and other laws. You may view and use the Site for your personal, non-commercial purposes only. You may not copy, reproduce, modify, distribute, publish, transmit, reverse engineer, create derivative works from, or otherwise exploit any Site content without our prior written permission.

7. Acceptable Use

You agree not to use the Site for any unlawful or prohibited purpose, or in any way that could damage, disable, overburden, or impair the Site or interfere with anyone else's use of it. You may not attempt to gain unauthorized access to any part of the Site, other accounts, or any systems or networks connected to the Site.

8. Third-Party Links and Services

The Site may contain links to third-party websites or services that are not owned or controlled by Blondie's. We are not responsible for the content, policies, or practices of any third-party sites or services. Links are provided for convenience only and do not imply endorsement.

9. Disclaimer of Warranties

THE SITE AND ITS CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY INFORMATION ON THE SITE IS ACCURATE, COMPLETE, OR CURRENT. THIS SECTION DOES NOT AFFECT ANY SERVICE GUARANTEE STATED IN YOUR SEPARATE SERVICE AGREEMENT.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BLONDIE'S AND ITS OWNERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR DATA, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IF YOU ARE DISSATISFIED WITH THE SITE, YOUR SOLE REMEDY IS TO STOP USING IT.

11. Indemnification

You agree to indemnify and hold harmless Blondie's and its owners, employees, and agents from any claims, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the Site, your violation of these Terms, or your violation of any rights of a third party or applicable law.

12. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules. You agree to the exclusive jurisdiction and venue of the state and federal courts located in Travis County, Texas for any dispute arising out of or relating to the Site or these Terms.

13. Changes to These Terms

We may update these Terms from time to time. The most current version will be posted on this page with an updated effective date. Your continued use of the Site after changes are posted means you accept the updated Terms.

14. Severability; Entire Agreement

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full effect. These Terms, together with our Privacy Policy and any applicable service agreement, are the entire agreement between you and Blondie's regarding the Site.
